When Marijuana Is Legal What Will Happen To Drug Testing For Pot?

By that I mean, when marijuana becomes legal ( hopefully it will be legal in all 50 states…) if you show positive for THC in your system will you still not be eligible to work somewhere? Every time you are drug tested and it comes up with THC+ you do not pass.
How will legalizing marijuana change this?
Or will it change it at all?
Can I still get a job in my state if marijuana is legal and I show up with it in my system on a drug test?

First and foremost: Marijuana will be legalized within the next 40 years. Take my word for it. The door is open and it’s going to be nigh impossible to close it again. The same thing can be said for same-sex marriage, but that is neither here nor there.
If something is deemed legal, there is an expectation that it will be constitutionally protected as it pertains to employment. This does not apply evenly across the board, unfortunately, but in this situation I would expect it would not be legal to dismiss someone from employment on the basis of THC in their blood. Much the same as you cannot fire someone for going to the bar and having a drink after work.
Having alcohol in your system affects you at a job only if you are on the clock when the test is administered, as most employers have clause vs. being intoxicated in the work place as a part of their employment contract. ( typically in America when you are being drug tested by your employer, you are on the clock just to clarify that ).

i think testing for weed is pointless as is, the half life of thc can be up to a month, while its only active for a few hours at most. so you can test positive for thc, even if you’ve been stone cold sober for 28 days.

Alcohol is legal but if you test positive for it it can adversely effect your situation. So I think THC would be considered the same way even if legal.
For example if at work if your sent for a drug test they can test for the presence of alcohol.

well if your being drug tested for being introuble with the law itll be just like haveing booz they wont want you to do it but if its for a job they would probely stop testing for it unless there still against it

Hypothetically speaking Marijuana was legalized, testing would go down. No more P.O. testing you. However you would more then likely get tested by an employer, depending on your line of work. Corporate stores like Vons, Albertsons…etc, all those mediocre jobs most likely will not test you. They say they might test you now, but they never do. The chances of it being legalized are slim though.
Stop answering these questions telling people to stop smoking marijuana, not what hes looking for.
And very very little places even test for alcohol. Usually drivers such as transporters, limo drivers etc, are the ones being tested every time they start there car. I used to be a driver for a mortuary transport company, and some mortuarys would install breathalizer tests in your car and you can only start the car if you pass the test saying your alcohol level is below the legal limit.
And Marijuana doesnt really mess up your body. Sorry to say but all this drugs are bad crap is way over exaggerated. I used to go to school high just about everyday, re-up sometimes during lunch, and i managed to hold a 3.0 GPA. And i was perfectly healthy, I would walk 2+ miles everyday and i never had the feeling that i could not breathe or some bull. Nothing wrong with it in my eyes.
And actually I think the government spends more money then it makes keeping marijuana illegal. I dont even think it makes a pofit tbh. With our current financial crisis, legalizing it ( though im pretty sure it wont happen) would actually be a plus. Not only would they be spending less tax dollars to fund special groups designated to abolish drug use. But they could also put taxs on it. And im sure no dealer would be able to keep up with the mass production and influx in marijuana if the government decided to take control of that market.

It will probably become company policy that a person cannot use marijuana while they are employed. Some companies may allow it, but the majority are not, unless a system can be implemented that tests if the person is high at the moment beyond just a person’s opinion.
It will be up to the company if they want their employees to use marijuana even if it is legal.

I’m sure the employee reserves the Right to design the test for no-dugs in systems. Since Marijuana is in the system for 10-20 days for light users or 30-45 days for heavy users, they can be sued for many things because you were impaired.
So any Driving or Machine operators, it would not be insurable thus no JOB.
And for office jobs, anyone can use your Habit as an excuse, because your impaired. ” yes I am talking about the next morning”
I used to be a heavy pot smoker, and honestly it doesn’t help job performance, it only hurts it.
I know there are many who think they are different, I was that person too, but the reality is Pot is not reality.

We all need to realize that weed will never be legal. As much as I would love it ( im actually smoking a bowl right now) it will never happen. My G-pa is in the senate. Weed is the number one enemy is the war on drugs, they are more worried about weed than they are crack meth etc. And plus anyone could grow weed so they would have no way to tax it and you know that they will never let tons of ppl make money and not share with them.

Even if it is legalized (Highly unlikely) most companies can still refuse to hire you if you test positive.
Best thing is to stop abusing your body and mind and don’t do mind altering drugs like pot.

It would be the same as showing up drunk. Legal pot? Dream on! They make to much money on the stuff being illegal. Pot is not good anyway. Ask Bill C.
