Does Marijuana Possession Include The Weight Of The Dried But As Well As The Weight Of Any Live Plants?
In Colorado it is a petty offense to own less than 1 oz of marijuana as long as it isn’t sold. Does this include the live plant or just the dried material? If it includes the plant does it count the weight of the entire plant or just the usable parts?
I’m writing a paper about the legal status of marijuana and these details were not very specific.

Unless the plant has just sprouted, it will be over an ounce regardless of what parts, and when, you weigh.
In most states, I believe it’s the weight of the product as it was when confiscated. But for an amount of an ounce, there wouldn’t be that much difference in volume between dried and live. It’s unlikely that you could raise an entire plant that weighed an ounce or less, so that would be definitely over the limit. If you’re just using fresh leaves, that would be slightly more than dried just from water weight.
It`s the same in N.C. but a live plant is considered to be manufactoring with intent to sell, which is a felony!
